1. ACCEPTANCE.

This site is operated by I Love Ferry, S.L. (“I LOVE FERRY”). Your use of this site is expressly conditioned on your acceptance of the following terms and conditions. By using this site, you agree to these terms and conditions. If you do not agree with any part of them, you must not use this site.

2. USE OF SITE.

I LOVE FERRY grants you a limited, non-transferable license to use this site in accordance with this User Agreement. You may only use this site to make legitimate reservations or purchases and not for any other purpose, including, without limitation, speculative, false or fraudulent reservations or reservations made in anticipation of demand.

This site and its content, including text, graphics, button icons and digital downloads, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of I LOVE FERRY, except that you may download, display and print the materials on this site for your personal, non-commercial use only.

Except for search engines and other crawlers permitted by our robots.txt file, you may not use any robot, spider or other automated device, program, algorithm or methodology, or any manual process, to monitor or copy the pages, data or content of this site without the prior written permission of I LOVE FERRY. You may not transmit or transfer the pages, data or content of this site to any other computer, server, website or medium for mass distribution or for use in any commercial enterprise.

You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this site, and not to take any action that imposes a load on our infrastructure that I LOVE FERRY, in its sole discretion, considers unreasonable or disproportionate.

Unauthorized use of this site and/or its materials may violate copyright, trademark or other intellectual property laws or other laws. You must keep all copyright, trademark and other proprietary notices contained in the materials and must not alter, obscure or remove them. Use of these materials on any other website or networked computer environment is prohibited.

You may not post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material, or any material that could constitute or encourage conduct that would be a criminal offense, give rise to civil liability or otherwise violate any law. You also may not post or transmit any information that (a) infringes the rights of others or violates their privacy or publicity rights, (b) is protected by copyright, trademark or other proprietary right, unless you have the express written permission of the owner, (c) contains a virus, bug or other harmful item, or (d) is used to unlawfully collude against another person in restraint of trade or competition. You are solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from your use of this site.

3. RESPONSIBILITY.

You represent that you are of legal age to use this site and to enter into binding legal obligations for any liability you may incur as a result of its use. You are responsible for the accuracy of the information you provide and financially responsible for all uses of this site made by you or on your behalf.

4. REVIEW OF TRANSMISSIONS.

I LOVE FERRY may monitor and review any information transmitted or received through this site and reserves the right to edit, remove or refuse the transmission or receipt of any information that it considers inappropriate or contrary to these terms and conditions. During monitoring, information may be examined, recorded or copied, and your use of this site constitutes your consent to such monitoring and review.

If you submit suggestions, ideas, comments or questions, or post any other information on this site, you grant I LOVE FERRY and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content in any form, media or technology. I LOVE FERRY takes no responsibility and assumes no liability for any content you post or submit.

5. EXCLUSION OF WARRANTY.

To the extent permitted by law, I LOVE FERRY and its third-party providers and distributors make no warranty of any kind regarding this site or its materials, which are provided “as is”. They do not warrant the accuracy, completeness, currency or reliability of the content or data on this site and expressly disclaim all warranties and conditions, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither I LOVE FERRY nor its third-party providers or distributors warrant that this site, its servers or any email sent by I LOVE FERRY are free of viruses or other harmful components.

6. LIMITATION OF LIABILITY.

While we try to ensure that the information on this site is accurate, we cannot guarantee that it will always be error-free. We endeavor to correct errors and omissions as quickly as practicable, but we accept no liability for them.

I LOVE FERRY is not liable for any damage to, or viruses that may infect, your computer equipment or other property as a result of accessing, using or browsing this site or downloading any materials, data, text or images from it.

To the extent permitted by law, in no event shall I LOVE FERRY or its third-party providers or distributors be liable for any injury, loss, claim or damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, without limitation, lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, arising out of or in any way connected with:

(i) any use of this site or its content;

(ii) any failure or delay, including the use of or inability to use any part of this site for reservations or ticketing; or

(iii) the performance or non-performance of I LOVE FERRY or any third-party provider or distributor, even if advised of the possibility of such damages.

If, notwithstanding the above, I LOVE FERRY or any third-party provider or distributor is found liable for any loss or damage arising out of or connected with the uses of this site described above, their total aggregate liability shall not exceed the greater of (a) the service fee you paid to I LOVE FERRY for the booking concerned, or (b) US$100.00.

I LOVE FERRY may, at any time and without notice, terminate or restrict your access to any part of this site.

Nothing in these terms limits any liability that cannot be limited or excluded under applicable law, or any mandatory consumer rights you may have. Your ferry bookings are also governed by our Booking Conditions.

7. INDEMNIFICATION.

You shall defend and indemnify I LOVE FERRY and its third-party providers and distributors, and their officers, directors, employees and agents, against any claim, cause of action or demand, including reasonable legal and accounting fees, brought by you or on your behalf in excess of the liability described in these terms, or brought by third parties as a result of your use of this site.

8. LINKS.

This site contains links to other websites that are provided solely for your convenience and do not imply any endorsement by I LOVE FERRY or its third-party providers or distributors of their content. Neither I LOVE FERRY nor any third-party provider or distributor is responsible for the content of other websites or makes any representation or warranty about them. If you access other websites, you do so at your own risk.

9. RELATIONSHIP.

The relationship between I LOVE FERRY and you is that of independent contractors, and neither party nor any of its officers, agents or employees will be considered a partner, joint venturer, fiduciary, employee or agent of the other.

10. INJUNCTIVE RELIEF.

You acknowledge that any violation or attempted violation of this User Agreement may cause I LOVE FERRY irreparable harm, the exact amount of which would be difficult to determine. Accordingly, I LOVE FERRY shall be entitled to seek an injunction from any competent court to restrain such violation or attempted violation by you or your affiliates, partners or agents, and to recover from you the reasonable costs and attorneys’ fees incurred in obtaining it.

11. TERMINATION.

I LOVE FERRY may terminate this User Agreement and/or the provision of any of its services at any time and for any reason, including improper use of this site or your failure to comply with these terms and conditions. Termination will not affect any right to relief to which I LOVE FERRY and its third-party providers and distributors may be entitled. Upon termination, all rights granted to you will end.

12. ASSIGNMENT.

You may not assign, transfer, subcontract or delegate your rights or obligations under this User Agreement.

13. MODIFICATION.

I LOVE FERRY may modify these terms of use at any time. Your use of this site is subject to the terms of use in force at the time of use.

14. BOOKING CONDITIONS.

When you purchase products on this site, you agree to the applicable terms and conditions, including cancellation and change penalties, which you must read before completing your booking: see our Booking Conditions and Travel Terms and Conditions.

15. ENTIRE AGREEMENT AND GOVERNING LAW.

This User Agreement, together with any additional terms and conditions incorporated or referred to in it, constitutes the entire agreement between us on its subject matter and supersedes any prior understanding or agreement, oral or written. It may only be amended in writing or by publishing the amendments on this site. It is governed by Spanish law, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
